Rental Agreement

This Rental Agreement, including the Liability Waiver below, governs your rental. By checking the agreement box at checkout, Customer agrees to all terms and fees.

Equipment. Standard totes measure 21 by 15 by 12 inches, approximately 12 to 13 gallons, with an attached hinged lid and a 35 lb maximum load. Extra totes may be added to any package at $5 each, subject to availability. Larger totes may be offered as inventory allows.

Rental Terms 1. Ownership. All totes and equipment remain the sole property of FN Moving Tote Rentals, LLC. at all times. Customer receives a temporary right to use only. Transfer to any third party is prohibited.

2. Rental Period. One week from the delivery date, with the option of a second week for $35. The maximum rental is two weeks.

3. Delivery. Totes are delivered to the nearest accessible point, such as the front door, driveway, or garage entrance. We do not enter the home. Someone 18 or older must be present to accept delivery. If no one is present on arrival, delivery will not be completed and a $25 redelivery fee applies before redelivery is rescheduled.

4. Stair Fee. If the delivery or pickup address requires climbing stairs to reach the front door, a $10 per flight stair fee applies at both delivery and pickup. We carry totes to an upper floor front door, never inside the home. Stairs must be disclosed at booking.

5. Pickup. All totes must be stacked and accessible at the front door or driveway on the scheduled pickup date. We do not enter the home to retrieve totes.

6. Pickup Count and Condition. We count and inspect the totes at pickup and document them with photos. Our photo record is the final account of the count and condition of the totes.

7. Late Returns. After the scheduled pickup date, a 2 day grace period applies at no charge. On the third day past the scheduled pickup, the $35 second week fee applies. If the totes are not returned or made available for pickup by the end of the second week, they are considered not returned, and the customer is charged the $20 per tote replacement fee for the full set. At that point the totes are considered purchased and are no longer due back.

8. Damage and Loss. $20 per tote for lost, stolen, or damaged totes, assessed at pickup.

9. Responsibility for Equipment. You are responsible for the totes and equipment from the time of delivery until we pick them up. This includes loss, theft, and damage from fire, water, weather, or misuse, beyond normal wear. Keep the totes secure and protected from the weather.

10. Tote Care. Do not place stickers, packing tape, duct tape, or permanent markings on totes or lids. Sticky notes, paper tags, and regular Scotch tape are acceptable. Totes returned with residue or markings are subject to a $5 per tote restoration fee. Some totes may show minor wear from previous use. All totes are fully sanitized before every rental.

11. Prohibited Use. Open or unsealed liquids, leaking containers, hazardous materials, illegal items, and any substances likely to spill, leak, contaminate, stain, or damage the totes are prohibited. Liquids, food, and household products must be securely sealed in leak-resistant containers. Maximum 35 lbs per tote.

12. Service Area. We serve Bexar County, Texas only. Delivery and pickup are free within Loop 1604. Outside Loop 1604 but within Bexar County, a $15 fee applies to delivery and a $15 fee applies to pickup. We do not serve addresses outside Bexar County.

13. Payment. Processed securely through Stripe. Texas sales tax of 8.25% applies as required by law.

14. Payment Authorization. By placing an order, you authorize FN Moving Tote Rentals, LLC. to charge the card on file for the rental and for any additional fees authorized by this agreement and the Master Fee Schedule, including applicable second-week, redelivery, rescheduling, stair, extended-zone, restoration, and replacement fees. These fees may be charged as they are incurred.

15. Refunds and Cancellations. Refunds, cancellations, and rescheduling are governed by our Refund and Cancellation Policy, available on our website. Early returns are not refunded. The full rental fee applies regardless of when the totes are returned.

16. Accurate Information. You agree that the name, contact details, and delivery and pickup addresses you provide are accurate and current.

17. Right to Refuse Service. We reserve the right to refuse, cancel, or end any rental at our discretion for any lawful reason, including suspected fraud, abusive or unsafe behavior, prohibited use, nonpayment, or unavailable inventory. If we cancel before delivery for one of these reasons, we refund what you paid for that order. We do not refuse service based on any legally protected class.

18. Discount Programs. Eligible customers may receive $25 off one initial tote-rental package. Veterans participating in the Bexar County Clerk’s Thank A Veteran Program may use code VET25 with a valid County Clerk-issued Thank A Veteran ID. Eligible active law enforcement officers, firefighters, EMTs, and paramedics may use code FR25 with proof of current service. For qualifying VET25 and FR25 rentals, extended-zone delivery and pickup fees are waived within Bexar County. Eligibility must be verified before the discount is applied. Discounts cannot be combined with other offers.

19. Governing Law. State of Texas. Disputes resolved in Bexar County, Texas.

Liability Waiver and Assumption of Risk Please read carefully. This section affects your legal rights.

1. Assumption of Risk. Customer understands that packing, lifting, stacking, and transporting loaded totes carries a risk of personal injury and property damage. Customer voluntarily assumes all such risk.

2. Release. TO THE FULLEST EXTENT ALLOWED BY LAW, CUSTOMER RELEASES AND HOLDS HARMLESS FN MOVING TOTE RENTALS, LLC., ITS OWNERS, AND ITS AGENTS FROM ANY AND ALL CLAIMS FOR PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS ARISING FROM OR RELATED TO CUSTOMER'S USE OF THE RENTED TOTES AND EQUIPMENT, INCLUDING CLAIMS BASED ON THE NEGLIGENCE OF FN MOVING TOTE RENTALS, LLC. This release does not apply to gross negligence or willful misconduct.

3. Safe Use. Customer agrees to follow the Safety Instructions provided, including the 35 lb per tote weight limit and the 5 tote stacking limit.

4. Indemnification. Customer agrees to indemnify FN Moving Tote Rentals, LLC. against claims brought by third parties arising from Customer's use of the totes and equipment.
